IRS Form W-9 & OFAC

If you are a claimant entitled to an allowed claim distribution, it is required by the plan that a completed IRS Form W-9  and OFAC be provided prior to receiving a distribution. Please submit these forms to the Liquidating Trustee by mail or email. 

TIMELINE & DEADLINES

Key Event Dates

  • ​Petition Date: August 1, 2025

  • Asset Sale Closure: January 16, 2026

  • Plan Confirmation Date: July 14, 2026

  • Plan Effective Date: August 1, 2026

  • Initial Distribution: No later than 35 days after the Effective Date*

*Any Holder [of an allowed claim] that fails to timely return the executed Pre-Distribution Certifications [so that they are received by the Liquidating Trustee] within such thirty (30) day period shall be deemed to have forfeited its right to receive Distributions and shall be forever barred and enjoined from asserting any right to Distributions made prior to the Liquidating Trustee’s receipt of the executed certifications.

  • Governmental Claims Bar Date: January 29, 2026

  • Rejection Damages Claims Bar Date: August 24, 2026
